WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK & INDEMNIFICATION

Reset Vibes Yoga & Pilates Experiences

THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS. PLEASE READ CAREFULLY.

By purchasing a ticket, enrolling in classes, purchasing a membership, or otherwise participating in any activity offered by Reset Vibes Yoga & Pilates Experiences (“Reset Vibes”), I acknowledge, understand, and agree to the following:

1. VOLUNTARY PARTICIPATIONI knowingly, freely, and voluntarily choose to participate in activities offered by Reset Vibes, including but not limited to one-time events, recurring classes, workshops, wellness experiences, memberships, and animal-assisted activities.

I understand that participation is entirely optional and that I may choose not to participate at any time.

2. ASSUMPTION OF RISK

I understand that participation in wellness, fitness, yoga, pilates, sound healing, group activities, and animal-assisted experiences involves inherent, known, and unknown risks, including but not limited to:

physical injury, strain, or discomfort
emotional or psychological responses
allergic reactions or sensitivities
slips, falls, or contact with surfaces or equipment
interaction with other participants
interaction with animals
exposure to environmental conditions, sounds, scents, and shared public spaces

I acknowledge that these risks may arise even when reasonable care is exercised.

I knowingly and voluntarily assume all risks, whether foreseeable or unforeseeable, arising from my participation.

3. MEDICAL REPRESENTATION & ALLERGY ACKNOWLEDGMENT

I represent and agree that:

I am physically, mentally, and emotionally capable of participating
I have consulted, or chosen not to consult, a licensed medical professional
I am fully aware of my personal medical conditions, limitations, sensitivities, and allergies

This includes, but is not limited to:

food and beverage ingredients (including cacao)
essential oils, incense, or aromatic elements
animals
environmental and airborne factors
contact with other participants

I understand that it is my sole responsibility to:

disclose known conditions or allergies
take appropriate precautions
refrain from participation if I feel unsafe

I accept full responsibility for my health and wellbeing before, during, and after participation.

4. ANIMAL-ASSISTED ACTIVITIES

I understand that some Reset Vibes activities may involve interaction with animals.

I acknowledge that:

animals may behave unpredictably
interaction with animals is entirely voluntary
animals are not owned, controlled, or trained by Reset Vibes

I knowingly and voluntarily assume all risks related to animal interaction, including but not limited to scratches, bites, allergic reactions, emotional responses, injuries, or incidental contact.

5. CODE OF CONDUCT

I agree to conduct myself respectfully and safely toward:

instructors
staff
other participants
animals
the facility and its property

I understand that unsafe, careless, aggressive, disruptive, or disrespectful behavior may result in immediate removal from the session without refund or credit and may result in suspension or permanent denial of future participation.

6. FULL RELEASE OF LIABILITY

To the fullest extent permitted by law, I hereby release, waive, and discharge Reset Vibes Yoga & Pilates Experiences and all related parties, including but not limited to:

owners and managers
instructors and staff
contractors and volunteers
partner organizations
event venues
property owners and landlords
agents, representatives, and affiliates

from any and all claims, demands, causes of action, damages, or liabilities arising out of or related to my participation, including claims based on negligence, to the maximum extent allowed by law.

7. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless Reset Vibes and all parties listed above from any claims, losses, damages, costs, or legal expenses (including attorneys’ fees) arising from:

my participation
my conduct
my breach of this Waiver
claims brought by or on behalf of minors for whom I am responsible

8. CONTINUING & SCOPE OF AGREEMENT

This Waiver applies to:

all current and future participation
all locations
all formats (in-person, outdoor, pop-up, private, group, or partnered events)
all memberships, packages, and recurring programs

This Waiver remains in effect unless revoked in writing by Reset Vibes.

9. PHOTOGRAPHY & MEDIA RELEASE

I grant Reset Vibes permission to use my image, likeness, voice, or appearance in photographs or recordings for marketing, promotional, educational, or informational purposes, without compensation.

10. MINORS

If I am signing on behalf of a minor, I certify that I am the parent or legal guardian and agree to all terms of this Waiver on the minor’s behalf.

I accept full responsibility for the minor’s participation and conduct.

11. GOVERNING LAW & VENUE

This Waiver shall be governed by and interpreted in accordance with the laws of the State of Illinois, without regard to conflict of law principles.

12. SEVERABILITY

If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13. ACKNOWLEDGMENT

I acknowledge that I have read this Waiver in its entirety, understand its terms, and sign it freely and voluntarily, intending to be legally bound. I acknowledge and agree with this waiver checking the box while booking a class online.

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“Participant,” “Client,” “You”) and Reset Vibes Yoga & Pilates Experiences (“Reset Vibes,” “Company,” “We,” “Us,” “Our”).

By accessing our website, purchasing tickets, enrolling in classes, purchasing memberships, or participating in any services, events, or activities offered by Reset Vibes, you agree to be bound by these Terms.

1. NATURE OF SERVICES

Reset Vibes Yoga & Pilates Experiences provides wellness, movement, mindfulness, and experiential services, including but not limited to:

Yoga and Pilates instruction
Sound healing, sound baths, meditation, breathwork
Cacao ceremonies and ceremonial wellness experiences
Animal-assisted wellness events
Workshops, pop-ups, private sessions, group classes, retreats
In-studio, outdoor, off-site, and third-party venue events
Regular classes, class packages, memberships, and recurring programs

All services are provided solely for educational, recreational, and general wellness purposes and do not constitute medical, therapeutic, diagnostic, or psychological treatment.

2. NO MEDICAL OR THERAPEUTIC ADVICE

Reset Vibes does not provide medical advice, diagnosis, or treatment.

Participation is not a substitute for professional medical care. You are solely responsible for consulting a licensed healthcare provider prior to participation.

3. ELIGIBILITY & AGE REQUIREMENTS

Participants must be at least eighteen (18) years of age unless otherwise stated
Minors may participate only when accompanied by a legal parent or guardian who has executed all required waivers
Reset Vibes reserves the right to refuse participation for safety, behavioral, or operational reasons

4. BOOKINGS, TICKETS & PAYMENTS

All bookings require advance payment
Tickets, packages, and memberships are non-transferable unless explicitly stated
Prices, schedules, instructors, formats, and venues are subject to change
All applicable taxes, service fees, and processing fees are non-refundable

A booking is confirmed only after full payment is successfully processed.

5. REFUNDS, RESCHEDULING & TICKET TRANSFERS

General Policy

All ticket sales are final. Refunds are not provided under any circumstances, including but not limited to no-shows, late arrivals, scheduling conflicts, or personal reasons.

Event Rescheduling (One-Time Events)

Rescheduling may be considered only if all of the following conditions are met:

A written request is submitted at least forty-eight (48) hours prior to the scheduled event start time
Rescheduling is subject to availability and only possible if space exists in a future event
Approval is at the sole discretion of Reset Vibes
No rescheduling requests are accepted within forty-eight (48) hours of the event

If approved, the ticket may be moved to a future event of equal or lesser value. Any price difference is not refundable.

Ticket Transfers

Ticket transfers to another individual may be requested up to twenty-four (24) hours prior to the event
Transfer requests must be submitted in writing
Tickets may be transferred once only
Approval is at the discretion of Reset Vibes

Memberships & Recurring Programs

All memberships are final sale, non-refundable, and non-transferable at any time
Memberships may be placed on pause once every six (6) months for a maximum of one (1) month
Pause requests must be submitted in advance and confirmed by Reset Vibes
No credits or benefits accrue during a paused period

Reset Vibes reserves the right to deny or revoke pause requests in cases of misuse or policy violations.

Event Cancellations by Reset Vibes

If Reset Vibes cancels an event, we may, at our sole discretion, offer a credit, rescheduled session, or refund.

6. LATE ARRIVAL & DENIED ENTRY

Late arrivals (arrivals more than 10 minutes after start) may be denied entry for safety and experience integrity.

No refunds or credits are issued for late arrivals.

7. ASSUMPTION OF RISK

Participation involves inherent and unpredictable risks, including physical injury, emotional responses, allergic reactions, interaction with animals or other participants, and environmental factors.

These risks may result in serious injury or other significant health consequences, even when reasonable precautions are taken.

8. ANIMAL-ASSISTED EVENTS

Animals may behave unpredictably. Interaction is voluntary.

Reset Vibes makes no warranties regarding animal behavior and disclaims liability related to animal interaction.

9. PERSONAL PROPERTY

Reset Vibes is not responsible for lost, stolen, or damaged personal belongings.

10. PHOTOGRAPHY & MEDIA CONSENT

By attending any Reset Vibes activity, you grant irrevocable permission for photography, video, and audio recording and their use for marketing, educational, and promotional purposes.

Written notice must be provided in advance to opt out.

11. CODE OF CONDUCT

Participants must behave respectfully toward other participants, instructors, staff, and animals.

Unsafe, disruptive, careless, or inappropriate behavior may result in immediate removal without refund and denial of future participation.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Reset Vibes shall not be liable for injury, illness, allergic reactions, emotional distress, property damage, or other losses arising from participation.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Reset Vibes from any claims, damages, losses, or legal expenses arising from your participation or violation of these Terms.

14. PERSONAL INFORMATION & DATA USE

By purchasing tickets, enrolling in classes, or participating in any Reset Vibes services, you may provide personal information including, but not limited to, your name, email address, phone number, and payment-related details.

Reset Vibes agrees that:

We do not sell or disclose personal information to third parties for their independent use
We take reasonable measures to protect your data

You acknowledge and agree that:

You grant Reset Vibes the right to use your contact information for marketing, promotional, educational, and operational communications, including emails, text messages, newsletters, and announcements.
You may request removal of your personal data or opt out of communications at any time by contacting us

15. GOVERNING LAW & VENUE

These Terms shall be governed by the laws of the State of Illinois, United States.

16. SEVERABILITY & ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Reset Vibes.
